British citizen Meredith Kercher was killed during a home invasion robbery in the beautiful hilltop city of Perugia, Italy.  She died on All Saints Day 2007 and is remembered for her virtuous qualities of “humble, loving and kind.”  Coincidentally her mortal remains would be found on All Souls Day, the solemn feast day remembering the dearly departed.  That both of these revered holidays became the backdrop for a sensational murder investigation is an incredible twist of fate.

But before Rudy Guede took her life on that cold and windy November night, Meredith Kercher is enjoying a dream come true.

THE CALM

AUGUST 2007, PERUGIA, ITALY

A few steps outside Perugia’s massive 4th century Etruscan walls, and perched above the Fosso del Bulagaio ravine, sits an old farmhouse that had been renovated into a two-story duplex.  Via della Pergola 7 overlooks the Tiber River valley of North-central Italy, it sits across Viale Sant’Antonio from a parking garage and an apartment complex.  The ravine below is crisscrossed with a trail system thousands of years old, and one can still see a few fruit and nut trees in the neglected garden surrounding the villa.  Perugia, a college town, is home to the University of Perugia and the University of Foreigners, as well as the businesses that cater to the several thousand students who come and go.  Bars, discos, coffee shops, bookstores, grocery and clothing stores are sandwiched in between tiny student apartments and charming homes along the narrow streets.  There is a busy bus service that transports students to and from the discos and clubs downhill, in the outskirts of the city. Filomena Romanelli, 26, and Laura Mezzetti, 27, both work for a local law firm and have just rented the upper apartment of the villa.  Filomena, the leaseholder, has complained to the landlord that the front door lock is faulty and the shutters on her bedroom window will not close and latch, but otherwise it is a mansion compared to the cramped accommodations of other young adults in the city.  They are looking for two roommates to share the rent.  Filomena is dating Marco Zaroli, 25, and Laura is single. The lower apartment is already rented to four young Italian men: Marco Marzan, 22, Riccardo Luciani, 21, and cousins, Stefano Bonassi, 21, and Giacomo Silenzi, 22, all students at the University of Perugia.  The breathtaking view more than made up for the occasional vagrants they saw using the trail system, but Marco had once found a drunk sleeping in the garden, so everyone knew to beware of strangers. The young women looked to the young men as “protectors,” of sorts, and felt relatively safe. Meredith Kercher, 21, from London, England, is preparing to leave for Italy.  Non-Italian speakers are required to have a working knowledge of the language before moving on to other universities in Italy and the University of the Foreigners offered language classes.  Plus it featured a “small-town” atmosphere that Meredith found attractive.  The Erasmus Programme, supported by the University of Leeds in Leeds, England, allowed her to take one more step in following her dreams.  She is considering following her father and brother’s footsteps into the world of journalism and broadcasting, her focus is International Studies.  John Kercher Sr. had been a fixture in the British media for decades, even authoring a series of biographies featuring musical groups from the Golden Age of Rock and Roll.  He still looks the part of 60’s hipster and one can easily see him covering the Beatles during the British rock scene in Liverpool and London.  Meredith’s oldest brother, John Kercher Jr. works behind the scenes for the BBC as an Internet Technology programmer.  Meredith, at age 18, is featured walking through the hauntingly beautiful backdrop of Kristian Leontiou’s 2004 “Some Say” video; before the end of 2007 the poignant words will become her swan song. Amanda Knox, 20, from Seattle, Washington, USA, is in Germany at her cousin’s home.  She is also eager to begin her year abroad and is about to take a side trip to Perugia with her sister Deanna where she will register for  classes at the University of Foreigners and look for an apartment.  Amanda, an honors student from the University of Washington, has planned a nine-month immersion study of the Italian language and culture, first in Perugia then on to Rome for a creative writing program hosted by the UW.  She is attracted to Perugia because it was off the beaten path and would offer a chance to master the language without the distraction of large numbers of English speakers.  Amanda is considering translator as a profession and had already mastered German, a language spoken at home.  She had taken the popular Japanese language classes offered in Seattle schools, part of the Pacific Rim experience, and had been an exchange student in Japan.  Ever the adventurer, she had decided her next conquest would be Italian, rather than following the crowd by taking Spanish or French.  A family trip a few years before had introduced her to the beauty and wonder of the country and Perugia’s medieval charm and history is appealing.  Coupled with her interest in writing, the classes in Rome would be the perfect fit.  For fun, the avid bibliophile had brought the Italian edition of “Harry Potter and the Chamber of Secrets” to practice grammar and translation. Raffaele Sollecito, 23, from the Mediterranean seaside town of Giovinazzo on Italy’s boot heel, is nearing completion of a bachelor’s degree in Computer Science at the University of Perugia.  He is interested in the off-beat world of Gaming and is immersed in not only the programming aspect, but also animation and design.  With graduation just a few weeks away, Raffaele is working on his thesis and preparing to enter a prestigious nine-month course at the University of Milan.  He wanted to study abroad as well and is attracted to both a master’s program in Ireland and the West Coast of the United States with its cultural connections to Japanese animation.  Raffaele is studying the Japanese Manga art form, popular in the gaming industry, and knew that the Pacific Rim states offered opportunities to work with the medium that Europe did not.  Plus California, a mecca for animators and graphic artists, had several universities and studios offering internships.  Raffaele’s sister Vanessa is also interested in traveling to the United States and the two are considering their options.  He has his own apartment inside Perugia’s city walls, a housekeeper and a car; all three a rarity for students. Rudy Guede, 21, accompanied his father Roger Guede from the Ivory Coast to Perugia when he was 5-years-old.  Roger was looking for new job opportunities and left young Rudy’s mother behind; she did not play a role in the boy’s upbringing.  Rather the village raised the young Ivorian after the boy took refuge on the streets to avoid his father’s beatings.  A kindly aunt in Milan, several friends and a teacher took turns fostering him. The Caporali family fostered Guede for a year in his late teens when Roger Guede returned to the Ivory Coast for an extended stay.  Paolo Caporali, a wealthy businessman who supported a Perugian basketball team, recognized the young man’s athletic talent.  The teenager lived in the lap of luxury for about a year, given a room, clothing, job and schooling, but was summarily dismissed for non-stop lying and refusal to go to school, study or work.  His former foster mother, Iliaria Caporali, took pity on him and helped him secure a student apartment just inside the city walls on Via Canarino and a gardener position at a company she owned, Il Castellaro.  Because Guede had recently quit, during September and October, he would drift between Perugia and Milan working odd jobs, clubbing, playing basketball and committing burglaries.  Occasionally he pretends to be a European Studies student to chat up the university women. Giuliano Mignini, 57, a native Perugino, has lived in the Umbria region all of his life and he’s risen to the respected, and powerful, position of Public Prosecutor.  Despite his rank he is being sued for Abuse of Office along with the Director of the Monster of Florence investigative squad, Officer Michele Giuttari.  They used their powers to spy on a Florentine peer and several journalists.  The wiretapping was discovered after a formal complaint was filed by Douglas Preston, an American writer, and his Italian associate, reporter Mario Spezi.  Spezi and Preston were about to release their book about an unsolved serial murder case when Mignini interrogated Preston and falsely accused him of obstructing the investigation.  In 2006, the prosecutor demanded Preston leave Italy then falsely imprisoned Spezi, naming him a Monster of Florence suspect.  It was an attempt to halt the publishing of Preston and Spezi’s book so that Giuttari’s book on the same subject could be released first.  Despite criminal acts, Preston and Spezi’s book “The Monster of Florence” was published on time and went on to become a bestseller.  The following year Mignini was insulted when Preston portrayed him as a brutta figura during an interview with the American TV show Dateline NBC that aired on June 20, 2007. The “British Girls,” as Meredith’s English friends are called, include Jade Bidwell, Robyn Butterworth, Amy Frost, Natalie Hayward, Helen Powell, Sophie Purton, Samantha Rodenhurst and a few others not called to testify.  Most of the group met at the University of Foreigners in early September and formed a close-knit clique.  The girls traveled in packs for mutual protection.  Robyn arrived in Perugia at the end of September/early October and found an apartment on Via Bontempi. Amy Frost, Robyn’s roommate, is an Erasmus scholar like Meredith, studying foreign languages. Guede claims that he met Amanda for the first time “in Le Chic in early September.”  However, Amanda was not in Perugia at that time, as she had returned to Germany and would not be back in Perugia until September 20. Meredith arrives in Perugia and stays at a hotel for just over a week.  Within a couple of days she tells her mother, Arline Kercher, that she is lonely and starts looking for a place to live.  Amanda and Deanna Knox arrive in Perugia so that Amanda can register for school and look for an apartment.  Near the University of Foreigners they see a young woman posting a ‘room-for-rent’ sign.  Laura Mezzetti leads the Knox sisters to Via della Pergola 7, a charming two-story villa with a panoramic view of the Tiber River valley and a short walk from the university.  The rent is 300 euro ($450) per month, so Amanda, delighted and relieved to find a room, signs the lease.  The sisters return to their cousin’s house in Germany to finish a two-week visit before Amanda and Deanna leave for Perugia and Seattle. Meredith Kercher becomes the fourth tenant of the upstairs apartment at Via della Pergola 7 after answering the same ad that Amanda and Deanna had found. Francesco Calamandrei’s Monster of Florence trial begins.  The Perugian pharmacist, and respected business owner, is accused of being the famed serial killer by Prosecutor Mignini, who used serial witnesses from a Monster trial ten years earlier, a schizophrenic and several tramps.  Calamandrei’s lawyer, Gabriele Zanobini, demolished the Perugian investigation, calling the results “waste paper” and the charges are dropped the following year. Diya “Patrick” Lumumba, a Congolese immigrant, hires Amanda to work at Le Chic, a newer bar inside the city walls.  She will work the three-hour evening shift, 9pm to 1am, handing out flyers after class and waitressing in the evening.  Juve becomes Patrick and Amanda’s interpreter, as neither speak the other’s language well enough to discuss complicated work procedures.  The men are patient with Amanda as she struggles to learn the ropes.  Patrick meets Meredith the same day that he hires Amanda, when she accompanies her friend to check out Le Chic.  Meredith demonstrates her Mojito technique for Patrick.  That day, Meredith also confides to Filomena that she had noticed that Giacomo Silenzi is interested in her. The EuroChocolate Festival begins, Perugia’s famed homage to the delicious confection, and will continue until October 21.  The streets fill with the delectable smell of chocolate as the Tramontana wind swirls the mouth-watering fragrance into every piazza and side street.  A city wide taste test begins as the confectioners delight the crowds with all manner of creations and demonstrations. Amanda has worked the evening shift at Le Chic for ten days and she is struggling to fit into the bar scene.  Patrick realizes that she doesn’t have the skill to handle crowds and, to Amanda’s relief, he hires a more experienced waitress for the busy nights.  He cuts her hours to Tuesday and Thursday nights so that she could continue to learn without being overwhelmed, but she has already applied to some of the bookstores in town.  Though she likes Patrick and is appreciative of the job, books are more to her liking than bars. Late Evening

The law offices of Paolo Brocchi in Perugia are broken into.  The alarm is turned off and a large rock thrown through the second story window.  The thief gained access by standing on a security grate on a door below.  Glass is scattered on top of items near the window, but oddly a few shards were carefully placed on a desk. The thief drank soda from the refrigerator and turned the heat on full blast.  A laptop computer, printer, USB flash drives, a mobile phone and a cell phone were reported missing. Morning

Amanda goes to Piazza IV Novembre to watch chocolate sculptures being carved.  While the artist is at work, an assistant, who is throwing chunks of chocolate from the carving to the crowd, drops a brick-sized piece into Amanda’s arms.  She rushes home to before it melts on her shirt, excited by her good fortune.  (2013 WTBH)

That night, after work, Amanda makes her way through the crowd to meet Meredith in the main piazza, she sees Giacomo and Marco.  Rudy Guede is introduced to Amanda when he walks out of the Shamrock pub and says hi to the guys; he had been to a birthday party.  Meredith meets up with Amanda and the group walks back to the villa together, Guede accompanies the guys back to their apartment while the women drop their purses off in theirs.  Guede experiences an awkward moment when he is asking the guys if Amanda had a boyfriend as she walks through the door.  He is introduced to Meredith when she joins them a few minutes later.  Guede ends up spending the night after the guys catch him sleeping on the toilet, too intoxicated to leave. Guede is caught inside Maria Del Prato’s Via Plinio nursery school in Milan when she arrives with two repairmen, including a locksmith, to beef up security after the October 8th robbery.  The group surprised Guede coming out of her office where he had been attempting to hook up his laptop computer using her power cord.  “He accepted that he was caught and was very calm,” said Del Prato. “We all had the feeling that he was a dangerous person.”  While the repairmen kept him from leaving, she called the police.   When the Milanese police searched Guede’s backpack they found a large butcher knife that was taken from the nursery’s kitchen, as well as a number of other stolen items: keys, a mobile phone, a cell phone, a woman’s gold watch and a little hammer used for breaking glass.  The mobile phone, cell phone and laptop were identified as belonging to the law firm of Paolo Brocchi, but Guede claimed he bought the laptop from an “unknown” man at the Milan train station and that he also paid “an informant” 50 euros to find a place to sleep, who then told him about the kindergarten.  The owner of the gold watch was not publically identified, but it is speculated that it belonged to Guede’s neighbor, Maria Mandu Diaz.  (2008 Maria Del Prato interview) (2009 Maria Del Prato testimony) (2009 Massei Motivation)

Lawyer Paolo Brocchi receives a call from the office of the Milan Police Commissioner Venezia Garibaldi.  Special agent Rita Spessi tells him they’ve found a suspect with stolen equipment in kindergarten and he recognizes his cell phone from a description of recovered property. Guede tells Brocchi that he received the stolen property from a stranger in the Milan Central railway station.  The lawyer says that he wants his property back, no mention of who is in possession of the lawyer’s property at the time of this conversation.  Guede leaves and Brocchi finds out about a month later that he is involved with Meredith’s murder after seeing his picture in the newspaper. Patrick arrives at Le Chic and opens the doors to “Crawloween.”  The weather is raining and chilly, perfect for vampires and monsters to walk the streets.  Town is packed and shuttle buses are taking students from city center to the clubs on the outskirts of town.  Piazza IV Novembre, Piazza Grimana and other popular gathering places play host to packs of chattering, laughing and screaming denizens of the night.  In Piazza Grimana party-goers are sitting on the low stone wall that encircles the basketball court watching for buses to arrive, some are running through the narrow streets shrieking with mock fright.  On the outskirts of town, the clubs are toasty hot by 1am, music thumping and bodies bumping.  The older residents watch with some concern, but generally tolerate the antics of the university students. Guede is caught on the parking garage’s CCTV camera 7, the angle captures the garage gate and villa gate across the street.   He walks toward the villa, back to the camera and is recognized by his jacket and shoes then disappears.  Independent crime scene professionals determined that shortly after this video was taken Guede used the grate under the window to gain access.  He flipped open the shutter and threw a rock through Filomena’s window then left the immediate area.  It is a common burglary ploy to break a window and then wait at a safe distance see if the noise attracts attention.  The ravine offers cover/escape, as well as access/escape to the corner of Viale Sant’Antonio and Via Della Pergola.  Piazza Grimana is a half block uphill from the corner. Amelie ends, Raffaele and Amanda go to the kitchen and make dinner, sautéed fish and salad.  Raffaele is washing dishes, before they start dinner, when the sink pipe breaks flooding the kitchen floor.  Again.  He grouses about the plumber’s poor work ethic while they mop up the mess, but he doesn’t have enough towels to do a proper job. Meredith is being attacked.  The fatal injury is 3 stab wounds on the left side of her neck, in the same place, in quick succession, from a short bladed knife whose hilt left a bruise on her skin.  Similar in size to the pocketknife Guede used to keep Christian Tremontano at bay while he escaped from the man’s apartment just over a month earlier.  The wounds match a knife (3.149 inches) half the size of the infamous Double DNA Knife (6.89 inches) used by the prosecution.  If the infamous kitchen knife had gone in hilt deep, three times, it would have nearly decapitated Meredith.  Defense expert, Professor Carlo Torre, testified that it is impossible that in a “moment of homicidal frenzy” a large knife could be driven to “precisely the same depth, measurable to a thousandth of an inch, three times in a row.” (2009 Carlo Torre testimony) (2009 Massei Motivation) (2013 WTBH)

About ten minutes later Guede is sitting on the toilet listening to his IPod with the volume on Loud when he hears “very loud screams.”  The IPod was never recovered.  First he says that it is dark in the kitchen with “only the dim light was from Meredith’s room,” then he says the lights are on in the kitchen, though they “were off” when he went into the bathroom. Curatolo’s testimony is often confused as a result of his heroin use:  “MASSEI: You said, “I was these from 9:30 to 10:00, I read L’Espresso, I hadn’t noticed the kids.”  CURATOLO: Certainly.  MASSEI: “I noticed them later”, but you continue to repeat 9:30-10:00, so it doesn’t work.  CURATOLO: That is, between 9:30 and 10:00.  MASSEI: So you arrived between 9:30 and 10:00…  CURATOLO: It must have been 5, 10 minutes. 9:30 is 9:30, 10:00 is 10:00, a half-hour’s time, so if I smoke a cigarette I need 5 minutes, in consequence…  MASSEI: You said, “9:30 to 10:00”. Then you added, “Later I noticed them” and therefore the “later” presupposes some passing of time. Vice versa you repeat 9:30 to 10:00, so…  CURATOLO: No, no. Guede turns off the lights in the apartment, but doesn’t lock the door as he flees into the cold night, he has tracked faint, but bloody, left shoe prints all the way down the hall to the front door.  During the windy night the faulty door will swing open and the fresh, cold air will eliminate any smell of blood, as well as dry the bloody footprints.  Guede flees into the Fosse del Bulagaio ravine below Meredith’s house to avoid people in the street.  There is “blood on his hands” and his pants are “wet” so he covers them with a sweatshirt.  Guede avoids detection by following the ravine down to Via Bulagaio, across the road, up a driveway and into a line of trees at the edge of a field that leads directly to the Lana house. The cover provided would have also give him time to calm down and think about what to do next.  On November 21, 2007, Raffaele’s lawyer witnessed another search of Rudy Guede’s apartment. Raffaele calls Vanessa and had “barely finished describing” what they found in Amanda’s apartment when she yelled, “Leave! Raffaele calls 112 back, reports a possible robbery at the villa and notes that Captain Ceppitelli is still impatient.  The audio later becomes a YouTube hit.  In it Raffaele calmly tells the police about the broken window, drops of blood in the bathroom, a locked door and missing roommate. Amanda’s voice is in the background supplying the address details.  Raffaele says that “nothing has been taken,” translating for Amanda, meaning that they didn’t know for sure what was missing since Filomena had not yet arrived.  There are no other people present when the call is made.  Ceppitelli thinks that the burglar left DNA on Filomena’s broken window. Battistelli finally finds Via della Pergola 7; he is captured by the CCTV camera 7 as he walks from the left of frame to the middle of the street and addresses a person standing near the gate.  Out of frame, he walks up to Raffaele and Amanda standing on the porch, flashes his badge and asks for Filomena.  They are both surprised at how quickly the carabinieri have arrived and wonder how they knew about Filomena; neither had mentioned her name to 112.  Neither realized, at first, that this man is not carabinieri.  With Raffaele translating as best he can for both, Battistelli tells them that two cellphones that belong to Filomena were turned in and Amanda tells Battistelli about the mess inside and the missing roommate. Marzi parks the car and the group goes inside the apartment to look around. A Carabinieri officer’s legs, identified by the stripe on his pants, are captured by CCTV camera 7.  The officer is walking left to right downhill toward the cottage gate.  He is followed seconds later by a Carabinieri patrol car that crosses the oncoming lane and slowly pulls into the cottage driveway. The Carabinieri officers call headquarters to advise that they have arrived at the villa and that there is an emergency, they note the number of distraught people in the yard and of the presence of the postal police. As they enter the apartment and look around, they become the ninth and tenth persons to cross-contaminate the faint bloody footprints on the floor. Arline Kercher phones John Kercher Sr. to tell him she has heard about a murder in Perugia.  John begins to call Meredith’s English phone, but it goes to voice mail. As Giacomo, Stephano, Alessio and his girlfriend drive past the villa they are shocked by the number of people at the scene.  Ironically, at that moment, Giacomo gets a call from police requesting an interview with both he and Stephano.  They notify their parents and wait for them to arrive before going to the police station. Sophie Purton receives a call from a woman connected with the Erasmus Programme in Perugia, she says a body has been found and asks if Sophie knows a girl named “Meredith.”  But the woman does not have a last name and some of the information given about the victim is incorrect.  Sophie hangs up, not sure if the woman meant Meredith Kercher or not, maybe there was another “Meredith” in Perugia.  She is in shock as she goes to Amy and Robin’s apartment to tell them about the call. The British Girls arrive at the police headquarters, everyone is upset and crying.  A few realize only then that Meredith is the murder victim since she is the one missing. John Kercher is stunned and frightened that Meredith has not picked up her phone for hours and begins calling contacts in the British media to find out what they know.  Amanda is sitting alone in a room, she asks a police officer who checked up on her if it really was Meredith who had been murdered; she is in denial since the police are not naming the victim.  The officer silently “ran his finger in a cutting motion across his neck” as he stares intently to make sure she understands.  Amanda is speechless, finally accepting that Meredith is dead, not knowing how to say the words.  She sits quietly, stunned by the confirmation. Amanda and Raffaele are sent back to the main waiting room where they find it crowded Amanda’s roommates, the guys downstairs, the British Girls, the owner of Merlin’s.  The group has been split into two groups, Italian and English speakers.  There is a translator nearby.  The British Girls pepper Amanda with questions and she tells them that Meredith’s body had been stuffed into the armoire, still repeating the mistranslation. Laura, Filomena, Marco, Amanda and Raffaele meet for lunch and discuss the police questioning amongst themselves.  They are still in shock over Meredith’s death, the last few days have been surreal between the cops and the media harassing them.  All have been told to not give statements.  Laura notes that Amanda has what may be a “scratch” on her neck, but doesn’t ask about it. She later mentions it to the cops, who use the tiny mark to insinuate that “Meredith scratched Amanda during The Fight.”  (In 2009 Amanda self-consciously informs the court that the “scratch” is actually a hickey.)  Amanda complains of the number of times she has been called in to answer the same questions over and over.  She tells the group of Mignini’s gross fixation on “anal sex” and “Vaseline,” it is invasive and they agree that the prosecutor should be asking Giacomo that question.  The group thinks the cops are merely “annoying.” They have no idea that they are witnessing Amanda and Raffaele being “softened up” for the interrogations that the police have planned for the next evening.  They would be charged with Meredith’s murder some 60 hours later. Whoever he was – if it was a man, as seems overwhelmingly likely – she knew him and let him into the front door.” “Leaks from the police inquiry indicate that the police are confident that she had sex with the man before being killed. The day after Amanda and Raffaele’s arrest, Gabriella Carlizzi posts on her website that Meredith was a “human sacrifice that bears close connection with the Narducci Case and with the Monster of Florence.”  She wondered if ‘those who committed this murder’ did it knowing the investigation would end up in Mignini’s lap, and in this way the ‘offered sacrifice’ to Satan would be a fair exchange for the protection they hoped to gain from Mignini’s investigations of their satanic rituals.”  She is referring to her work on the Il Mostro case with Mignini and Giuttari over the past decade.  Mignini adopts the Satanism-Halloween connection for his first Theory of the Crime in November 2007, it will be discarded and replaced with a new scenario at each court level as the prosecution throws pasta on a wall to see what sticks. Raffaele, Amanda and Meredith’s hard drives are destroyed in an “accident” by the police expert.  The hard drives for three of the computers have never been released to the defense team for independent examination, a denial of the defendant’s constitutional rights.  Raffaele was able to recover one of his, years later, it yielded little new information. NOVEMBER 19, MONDAY

Fingerprints found in Meredith’s bedroom are identified are as Rudy Guede’s, a warrant for his arrest is signed by Prosecutor Mignini. NOVEMBER 20, TUESDAY

Guede is arrested in Germany and Patrick is released from prison.  Raffaele and Amanda are held in custody and Guede is added as a co-defendant. “Guede did not call the police, as Amanda and I did, or volunteer information, or agree to hours of questioning whenever asked.  Rather, he fled to Germany as soon as the investigation began and stayed there until his arrest two and a half weeks later. Guede’s apprehension and eventual conviction on murder charges should have been the end of the story.” (2012 HB)
