Meera wife of the Suspect Atul Rao in padma priya’s case filed a Habeas corpus petition in the Karnataka High court on Tuesday.
A habeas corpus petition is a petition filed with a court by a person who objects to his own or another’s detention or imprisonment. The petition must show that the court ordering the detention or imprisonment made a legal or factual error.
In her petition, Meera stated her husband has been missing since June 14. She claimed the police have not produced him in any court of Law and alleged he may under illegal detention.
Neither the Delhi police nor the Karnataka police have a case against him as no complaint has been filed.
Delhi police telling the reporters, "we have no connection with the case except that the woman committed suicide in our area".
The right to petition for a writ of habeas corpus has long been celebrated as the most efficient safeguard of the liberty of the subject.
The most common of the other such prerogative writs are quo warranto, prohibito, mandamus, procedendo, and certiorari.
On Wednesday group of lawyers from Meera, withdraw the hibeas corpus petition and told that this move is due to the instruction from Atul Rao.
