Replying to a question by Nazir Ahmad Gurezi, Rather said the State Government has filed application before Supreme Court seeking exemption of its order issued May 2010 in respect of J&K regarding the recommendation of Padamna Bhan Committee.
Rather said though the State Government had decided to implement the sixth pay recommendations in favour of the judicial officers but the Law department as well as delegation of the judicial employees asked to wait till the outcome of the case in the Supreme Court so that appropriate decision could be taken in the matter.
Replying to the supplementaries of M. Y. Tarigami, Harshdev Singh, Rafi Ahmad Mir, Jagdish Raj Sapolia and Ch. Zulfikar Ali, the Minister assured the members that the case would be vigorously perused.
. Rather today informed the Legislative Assembly that the Finance Commission has submitted its report on November 30, 2010 to the Chief Minister, adding that the voluminous report is being examined. He said a separate dissenting note has also been submitted by one of the members of the commission.

He said that functions entrusted to the Finance Commission included mapping the regions and sub-regions with reference to well accepted development indicators, identifying the backward districts of the State and to assess the deviation of these districts from the mean developmental level of the State.
Rather said that the terms of reference also included to evolve a set of policy instructions to equalize and balance the dispersal of development across the districts. Identifying measures to bring about a paradigm shift in the approach for inter se allocation of resources by treating each region and sub-region within the region as a targeted economic unit for which captive resources and those to devolve from the State shall be determined with focus on economic returns for self-sustained growth.
He said the Commission had also to see formulation of a set of administrative measures aimed at bringing about reforms in decision making in governance and development through decentralized processes and mechanism.
The Minister said that the Commission has also asked to identify the employment backlog at the regional, sub-regional, district or the targeted economic unit level and recommend measures for removal of disparities, suggest measures needed to augment the resources of the State Government, particularly to supplement resources of Halqa Panchayats, municipalities and Municipal Corporations in the State, besides any other matter, which may be ancillary or incidental to the aforesaid functions.
The Minister said that reviewing the State of finance of the State and suggest restructuring of the public finances restoring budgetary balance, achieving macro-economic stability and debt reduction, suggesting measures for effective implementation of the recommendations and award under 12th Finance Commission, particularly Fiscal Reform and Budget Programme and correcting measures for debit reduction and sustainability besides overall improvement in human development and investment climate were also included in the terms of reference of the Finance Commission.
