This incident was due to a dispute between Dennis Kucinich and the Texas Democratic Party over a loyalty oath which is required by all candidates to sign in order to have their names placed on the ballot. Both Dennis Kucinich and singer Willie Nelson, who supports Kucinich refused the party oath that a candidate must support the eventual nominee of the party.
When filled for a spot on the primary ballot, Dennis Kucinich had crossed out the oath. The Federal Judge in Austin that handled the case ruled against Kucinich. The ruling was that the Texas Democratic Party had the right to require the oath.
Kucinich argued that it violated his First Amendment right.
Saturday is the deadline according to Texas to print out the absentee ballots so that they can reach voters who are overseas in time for the Texas primary on March 4.
Kucinich said that he plans to return to the United States 5th Circuit Court of Appeals in New Orleans to argue the case.
