The Delhi Central Administrative Tribunal has given a significant ruling on family pension.On a petition filed by one Subalaya Devi, wife of Kunoo Ram, a deceased Railway employee,demanding family pension, the Delhi Central Administrative Tribunal has dismissed the petition holding that the legal heirs or the legal representatives of a deceased Railway employee are entitled to get the family pension provided that the deceased employee had been regularised before his death when he was serving the Railways.Kunoo Ram was serving as a casual labourer in the Railways and despite of given a number of chances for appearing in a screening test to qualify himself, in order to making him eligible for regularisation,the deceased Kunoo Ram never availed those chances and until his death, he remained only as a casual labourer in the Railways.Hence the Central Administrative Tribunal, Delhi, rightly dismissed the petition since the deceased was not regularised when he was serving in the Railways, his wife, as his legal heir is not entitled to claim family pension from the Railways.
