SC issues detailed verdict validating emergency, PCO

The Supreme Court has delivered 110-page detailed judgement in two identical constitutional petitions challenging imposition of emergency of November 3, 2007 and PCO in the concerned office for issuing it to petitioners as well as respondents.

The judgement has been written by Chief Justice of Pakistan, Justice Abdul Hameed Dogar according to Supreme Court sources.

The two petitions were filed in the Supreme Court by Tikka Muhammad Iqbal Khan and Pakistan Wattan Party under Article 184 (3) of the constitution. Irfan Qadir Advocate and Barrister Zafarullah Khan represented the petitioners separately.

Sharifuddin Pirzada and Raja Ibrahim Satti besides others represented the federation and other respondents. Attorney General Malik Muhammad Qayyum appeared before the court on notice.

The Judgement has been signed by all the seven Judges of the bench.

The Judges of the Bench are Chief Justice Abdul Hameed Dogar, Justice Ijaz-ul-Hassan Khan, Justice Muhammad Qaim Jan Khan, Justice Musa K. Leghari, Justice Ch. Ijaz Yousaf, Justice Muhammad Akhtar Shabbir and Justice Zia Pervez, the sources said.

Earlier, the apex court issued a short verdict validating the promulgation of PCO and emergency.

The detailed verdict said that the president, federal government and Election Commission of Pakistan would ensure the holding of free, fair and transparent elections.

The verdict said that the judges, who did not take oath under PCO, are no more judges.
