The Union Minister for Law and Justice, Mr.Bharadhwaj has revealed that the retirement age of the judges of the High Courts and Supreme Court in India is proposed to be increased.
The present retirement age of the judge of the High Court is 62 and that of the Supreme Court of India is 65. Considering their experience and legal acumen, the Union Government has been toying with the idea of increasing their retirement age as prevalent in the Western Countries. In England the retirement age of a judge is 75. Whereas in US, there is no retirement for the judge of a Supreme Court and he can serve as a judge until his death.
Taking the above aspects into consideration, the Indian Government has proposed to increase the age of the judge of a High Court from 62 to 65 years and that of judge of the Supreme Court from 65 to 68 years.
While on the one hand the above age relaxation is beneficial since they pave the way for retaining and utilizing the experience of the senior judges for some more years. On the other hand, the extension of the tenures of the High Court and Supreme Court Judges by three more years, will stall and delay the promotional avenues of a number of judges who are eagerly awaiting for their turn of promotion into the High Courts as well as the Supreme Court. However, appointment of more judges for the High Courts and the Supreme Court may solve this problems to some extent.
