Sata was deported in March this year soon after arriving at Chileka Airport in the commercial city of Blantyre.
Soon after his arrival ,Sata was taken to Blantyre Police where he was detained for a number of hours before being driven to a border town of Chipata over 45 kilometres from Blantyre.
He was later handed to Zambian Police.
Sata has hired a Malawi lawyer, Ralph Kasambara to argue his case at the HIgh Court
Sata ,who lost presidential elections to incumbent president Levy Mwanawasa said the deportation was illegal .
Newspapers in Malawi reported that Sata was supposed to meet Dr. Bakili Muluzi, the former President of Malawi who wants to come back and has shown interest to contest the 2009 presidential elections.
Relations between Dr. Muluzi and the incumbent President Dr. Bingu Wa Mutharika soared after Dr. Mutharika resigned from United Democratic Front(UDF) ,the party which brought him to power, and formed Democratic Progressive Party(DPP).
He accused UDF of corruption .
